Because material evidence (an affidavit alleging forgery of a boarding pass) had been filed but was not before the Court due to Registry error, and because recall is permitted under High Court Rules r11.9 and the Horowhenua County v Nash test where justice so requires, the Court recalled its earlier judgment and directed that the defendant be permitted to file a reply affidavit and that the parties attend a further case management telephone conference.
