On the balance of probabilities the court found the appellant's required podiatry treatment was not available locally and that Mr Scaniglia provides particular skills, techniques and equipment constituting a somewhat unique form of treatment; therefore under Reg 6(4) the nearest place where the treatment was able to be provided for this claimant was Mr Scaniglia's clinic and the respondent must meet her transport costs to attend him.
