The Crown appeal succeeds: the sentencing Judge erred in approach/calculation by effectively combining discounts contrary to orthodox methodology and awarding an excessive discount for rehabilitation; applying a correct methodology and balancing relevant authorities the appropriate maximum rehabilitation discount in this context is 25%, resulting in a sentence of 47 months (three years and eleven months); the previous sentence of two years and nine months was quashed as manifestly inadequate.
