The court held that on the face of the lease the Jack's Trust was in breach of its covenant to pay rent at the higher rate from 14 February 2012 and that breach alone entitled the landlord to cancellation under the Property Law Act; however, weighing the competing interests and relief factors the court granted relief allowing the tenants a stay until the end of the first term, fixing the date for termination and possession to balance interests (tenant relief until 14 November 2014) and made no order as to costs.
