The Court concluded that the balance of convenience and overall justice favoured granting interim injunctive relief because the plaintiff showed removal of property in breach of the consent Orders and the defendant would not suffer irremediable prejudice; accordingly the defendant was ordered to return the property and to cease interfering with access and use of the Kelburn properties.
