Under s21 Administration Act 1969 the court removed William as executor and trustee because administration of a simple estate had stalled, there was apparent partiality/conflict and lack of progress prejudicing beneficiaries (urgency increased by serious illness of two beneficiaries); appointment of professional trustee (TEL) was expedient to ensure practical and efficient completion of administration.
