The court dismissed the proceeding subject to leave, ordered that the notices of claim in paragraphs 1(a)(i) and 1(a)(ii) of the application dated 2 August 2023 lapse and be removed from the relevant titles, and sustained the notice at paragraph 1(a)(iii) (Claverley Gardens) only until 5 May 2024, the orders being made on the basis of the undertaking in Ms MacLean's letter of 1 September 2023.
