Confiscation was quashed because evidence showed the vehicle's loss would impose undue hardship on the partner (principally by substantially restricting her ability to visit her son in Waimana given the infrequent, poorly aligned bus services and additional walking distance), and s129(4) bars confiscation where undue hardship would result.
