The Court held the Council acted within its statutory discretion and proportionate decision-making framework under the LGA: the Veros multi-criteria process and AES acoustic advice were reasonably relied upon, Reserves Act misdescriptions were immaterial because the proposed skatepark would be entirely on the Cory Park recreation reserve, Pepe Reserve was unsuitable for a skatepark as an esplanade/local purpose reserve, and consultation (including the CDRG) complied with s82; accordingly all three challenged Council decisions were dismissed.
