The Court found the proceeding was essentially an intra‑iwi dispute and did not meet the public interest threshold in r 14.7(e), and that the Trust Board acted unreasonably in parts of the litigation; because the Trust Board's claim to quash KPBL's resource consent was bound to fail, KPBL was entitled to costs on an indemnity basis, while Auckland Council was entitled to 2B costs certified for second counsel; GST to be excluded from KPBL's award.
