On the material before the Court Accent adduced independent expert evidence (engineer and quantity surveyor) establishing a real basis for a counterclaim/set-off exceeding Smart Slabs' claim, and there was evidence of unfairness/undue pressure and High Court authority supporting Accent's challenge to service; accordingly an interlocutory order restraining publication of the liquidation advertisement was justified under r 31.11.
