Kata v Accident Compensation Corporation (Injury related incapacity)
- Citation
- [2018] NZACC 114
- Court
- District Court
The medical and contemporaneous evidence showed symptoms in the claimed period were attributable to pre-existing bilateral osteoarthritis rather than the covered lumbar sprain, the appellant continued to work and play basketball and provided no contemporaneous medical certification of incapacity, and therefore the higher evidentiary threshold for retrospective weekly compensation was not met; the Corporation's decision to decline backdated weekly compensation was upheld.
