Because the appellant failed to lodge his claim before 1 October 1992 and did not file the required election notice by 31 March 1993, the statutory time limits in ss.135 and 147 of the 1992 Act bar entitlement to lump sum awards under the 1982 Act; the s.90(9) deemed determination only restores entitlement under the 1992 Act and cannot displace those statutory deadlines.
