On the balance of probabilities the Court found contemporaneous GP notes and physiotherapy findings supported a diagnosis of tendonitis at the time of the claim and that subsequent treatment plausibly resolved the inflammatory signs so later specialist reports showing regional pain syndrome did not displace the earlier established discrete injury; therefore the revocation of cover was incorrect and the appeal is allowed.
