The Court accepted the CAP's analysis that the most likely cause of the cuff tear was pre‑existing impingement and intrinsic tendon disease with progressive degeneration; the accident may have aggravated symptoms but did not cause the tear requiring surgery, therefore the appellant is not entitled to ACC cover and the appeal is dismissed.
