The Court held that after reasonable investigation the medical evidence did not establish a sufficient degree of probability that the appellant's ongoing foot pain or need for surgery were caused by the 23 June 2007 accident; accordingly ACC's decisions to suspend compensation and to decline funding for the surgery were justified and the appeals were dismissed.
