The respondent's letter did not constitute a 'decision' under s6 affecting the appellant's entitlements and therefore was not reviewable under s134; the Reviewer's declination of jurisdiction was correct and the appeal is dismissed.

Following the Court's ruling in the companion appeal (Decision No. 162/07), as a matter of law the respondent is entitled under section 252 of the Act to deduct amounts owing to WINZ from backdated weekly compensation; therefore the appellant's challenge fails and the appeal is dismissed.

The appeal is dismissed because the appellant's attempt to re-open the 27 October 1993 suspension was time-barred by the unextendable three month statutory review period; the 5 April 2000 letter was not a decision attracting review rights; the 1993 suspension therefore remains binding until the respondent decides otherwise.

The 24 November 1999 letter merely confirmed the 12 February 1999 decision and therefore was not a new reviewable decision; the appellant's application lodged on 13 February 2000 was out of time beyond the three month limit and the appeal must be dismissed.
