On the evidence the plaintiff failed to prove the 2009 arrangement created a nominee/trust relationship or that he retained beneficial title; the Court preferred the defendant's account that the funds were gifted to him. Consequently no fiduciary relationship, no trust, and no restitutionary liability arose and the plaintiff's claims were dismissed.
