The defendants' Calderbank letter did not justify increased or indemnity costs because it failed to address the central legal issues (unlawful means conspiracy and alleged contrivance), the legal principles were novel and difficult, and the factual matters identified did not make continuation of the claim so obviously unreasonable; accordingly the plaintiff was ordered to pay agreed 2B costs and disbursements.
