The appellant was not in employment within 28 days before the 16 October 2014 injury, had only one day of annual leave paid out (insufficient to extend earner status), and did not satisfy the preconditions for the seasonal-worker extension in cl 43(3)(b); therefore he was not an 'earner' at the time of injury and is not entitled to weekly compensation, so the Corporation's decision is upheld.
