The bequest was to the Little Sisters' 'convent at Hastings' for that convent's charitable purposes; because the Little Sisters no longer provide a residential presence or services in Hastings the charitable purpose is impossible to carry out under s32; the proposed replacement scheme may be approved but must be modified to emphasise personal compassionate Catholic care and to remove provisions inconsistent with the original relational, residential ethos; parties to amend and resubmit the scheme for final approval.
