- District Court
On the balance of probabilities the persuasive body of expert evidence establishes that a substantial portion of the appellant's psychotic/major mental illness is attributable to non-abuse genetic/biochemical causes and that apportionment of 30% for other causes (yielding a final WPI of 35%) was justified; ACC's decision based on Dr Vickers' assessment was correct and the appeal is dismissed.
