On uncontested expert psychiatric evidence the defendant was suffering from schizophrenia with commanding auditory hallucinations at the time of the killing and was therefore incapable of knowing his actions were morally wrong within the meaning of s23 Crimes Act; accordingly under s20(2) CPMIP the Court recorded a verdict of not guilty by reason of insanity and ordered detention as a special patient under s24(2)(a) CPMIP as necessary to protect the public.
