Section 69 Evidence Act 2006 does not apply to suppression of affidavit material from public dissemination; open justice is paramount and the respondents failed to show the requisite exceptional prejudice to justify confidentiality orders; the earlier Duty Judge confidentiality orders are rescinded except that paragraph 32 of Norrie's affidavit and paragraph 82 of Birnie's affidavit remain confidential and redacted if affidavits are provided to non-parties.
