Indemnity costs were refused because the behaviour, while unbecoming and meritless, did not meet the threshold for indemnity; however a 50% uplift was justified because the plaintiffs persisted in a meritless allegation that unnecessarily increased the defendants' costs. Costs awarded to defendant on 2B scale with step 30 assessed at 2C and second counsel costs allowed; certain disbursements reduced as excessive (LINZ/agent fees reduced to $3,500).
