Because the appellant obtained cover under the 1982 Act the 1982 definition of personal injury governs; the medical evidence on the balance of probabilities established that the 1987 accident caused a chronic pain syndrome and that some element of the appellant's ongoing pain is attributable to that accident, so the respondent was wrong to cease weekly compensation and the appellant's entitlement must be reinstated.
