The appellant failed to discharge the onus to show that his ongoing neck and shoulder problems were caused by the 1 April 1998 accident; contemporaneous and specialist medical evidence established the complaints were substantially the result of longstanding degenerative changes (gradual process), therefore s 10 applied and the respondent's decision to revoke cover was correct.
