- High Court
The Court found the high statutory thresholds in s104(1)(e) (high degree of brutality/callousness) and s104(1)(g) (particular vulnerability) were not met on the facts; having regard to culpability, comparable authorities and aggravating/mitigating factors, the appropriate starting point was 13.5 years reduced by six months for a late guilty plea, yielding an MPI of 13 years for life imprisonment; the unlawful possession sentence of one year is to be served concurrently.
