The Secretary lawfully exercised s116: he was required to consider current venue costs and did so by commissioning and relying on data, and s116 does not require limits to mirror current actual venue costs; the decision in 2013 to retain the existing Gazette limits pending a comprehensive reform was not unreasonable, and Pub Charity failed to establish legitimate expectation or factual reliance, so all declaratory and review challenges were dismissed.
