The Court held the Reviewer’s hearing conducted within three months after the 25 May 2003 application was properly constituted and the Reviewer was seized of jurisdiction to decide preliminary issues; because that review decision was not appealed and is binding under s147, s146 cannot be invoked to create a deemed decision in the appellant's favour; accordingly the appellant is not entitled to a deemed decision under s146 and the appeal on that issue is dismissed.
