The appellant failed to establish on the evidence that the 1 January 1992 lumbar strain caused her ongoing chronic pain or sequelae; radiology showed degenerative change without nerve root compromise and neurologist opinion attributed hyperaesthesia to prior encephalitis, so ACC was justified to suspend entitlements under s117 and to decline reimbursement for the claimed medications.

The judge accepted the appellant's sworn evidence as credible on the balance of probabilities, found there was a physical injury on or about 6 May 2002 related to his sanding work, concluded ACC's 28 June 2002 decision declining cover for lack of physical injury was incorrect (and alternatively that s30 could apply), allowed the appeal and awarded costs of $2,500.
