The Court preferred Dr Collier's assessment over Dr Codyre's, finding insufficient evidence that the DSM-IV-TR criteria for PTSD (notably re-experiencing and avoidance) were met arising from the 1 October 2009 incident; therefore no mental injury as defined by the Act was established and cover under s21B was not available, so the appeal was dismissed.
