The court held that the phrase 'treatment provided ... to a claimant in respect of personal injury by accident' in Regulation 3 includes treatment provided to a recipient of the claimant's sperm when that treatment is part of the integrated medical management of the claimant's infertility caused by personal injury; accordingly, in principle the Corporation should pay for intracytoplasmic sperm injection, subject to the Corporation's s.27(6) assessment of necessity and appropriateness for any specific proposal.
