There was insufficient evidence on the balance of probabilities that the appellant's four teeth were lost as a result of the hospital treatment; contemporaneous records indicated missing teeth pre-operatively and comprehensive post-operative notes would likely have recorded new dental loss, and the long delay in reporting further undermined causation, so the treatment injury threshold under s32(1)(b) was not met.
