The debtor failed to comply with the bankruptcy notice and cannot rely on a cross-claim because the alleged grounds were available and litigated in earlier proceedings; s 414(1) does not entitle the debtor to reopen substantive prior judgments not made under the Insolvency Act; accordingly the Māori Trustee proved the elements for adjudication and the court must adjudicate the debtor bankrupt and appoint the Official Assignee.
