Leave to appeal was refused because the District Court had correctly applied statutory tests (s110(3) and s77) and its determinations about completion of rehabilitation, occupational suitability and the adequacy of assessments were factual findings supported by evidence and therefore did not raise a question of law capable of bona fide and serious argument.
