The Court found the appellant had sufficient knowledge and opportunities to apply earlier, including explicit information and prior contact with case managers; it was not unreasonable for ACC to expect an earlier application and therefore ACC correctly declined to exercise its s83(3) discretion to backdate childcare entitlements; appeal dismissed; backdating cannot extend earlier than 1 April 2002.
