The ACC decision of 30 August 2012 was set aside because it failed as a matter of law to consider the mandatory factors in s87 and to take into account relevant material (notably the IOA, IMA and claimant's submissions and invoices); the failure rendered the decision manifestly wrong and required quashing and remittal for a fresh decision in accordance with statutory criteria.
