On the balance of probabilities contemporaneous documents and conduct established that the plaintiff knew of and agreed to her removal and share transfer; the transfer lacked statutory formalities but that procedural non-compliance did not amount to unfair prejudice under s 174 given plaintiff provided no funds or security and the ANZ financing relied on access to the Patels' residential equity and guarantees; the misrepresentation/misleading claim was not proved and relief under s 174 is declined.
