The Court accepted KNI's admissions, calculated the statutory maximum per breach as NZD 10,000,000, adopted a starting range of NZD 3.5–4.0 million for the sustained covert cartel conduct and, after applying a jointly submitted and court‑accepted 20% mitigation discount, imposed a pecuniary penalty of NZD 3,100,000 plus a NZD 100,000 contribution to the Commission's costs to give effect to the objectives of general and specific deterrence.
