Fines were an appropriate and proportionate penalty for the RMA offending by Huka View and Mr Berendt given the commercial context, the need for economic deterrence, the defendants' gross recklessness and non-cooperation, the reasonableness of the starting points under updated Chick bands, the company’s demonstrated net equity making payment feasible, and a 10% guilty plea discount for pleas entered on the morning of trial was appropriate.
