Because the Crown did not oppose and unusual circumstances existed (co-defendants' sentences were reduced following appellate authority Carr v R which lowered starting points by one year due to lack of actual violence/loaded gun), parity required the appellant's sentence be reduced by the corresponding adjustment; extension of time granted and original sentence quashed and substituted with reduced term.
