Rule 5.49 does not apply to an appearance objecting to jurisdiction by a non‑party respondent to an interlocutory application; Ora's protest to jurisdiction under r5.49 was impermissible and is set aside; service on Ora was validly effected pursuant to judicial leave under r6.30 and the court has jurisdiction to hear the freezing order application as ancillary to a substantive proceeding over which it has jurisdiction.
