The applicant demonstrated sufficient grounds to pursue a claim against her husband, showed it was impossible or impracticable to formulate that claim without the loan, mortgage and related documents, and established that Mr Chen (and likely Xie and Zheng) held relevant documents; confidentiality did not bar discovery, therefore pre-commencement discovery against Mr Chen was warranted while service issues against the others required adjournment.
