The Court removed Elizabeth Blakeley as trustee and vested the property in the remaining trustees because admissible medical evidence demonstrated she was incapable of performing trustee duties and the Court has statutory jurisdiction under ss 51 and 52 of the Trustee Act 1956 to remove a trustee under disability and vest the trust land; dispensing service and appointment of a litigation guardian was justified because the application affected trust administration only and the respondent lacked capacity to understand or give instructions.
