The proceeding is struck out because the plaintiff's claims are frivolous, vexatious and an abuse of process: the causes of action have been finally decided previously (res judicata), the plaintiff failed to serve and obtain consent from the Official Assignee despite causes vesting on bankruptcy, and the pleadings lack evidential foundation especially for conspiracy allegations; accordingly the claim is liable to be struck out under HCR r15.1(1).
