The Deed was held authentic because the plaintiff produced the Deed and the signature matched the defendant's signature; the defendant made a serious allegation of fraud but produced no evidence to substantiate it or the alleged one-page agreement or any quantification of set-off; accordingly there was no real defence and summary judgment was entered for the plaintiff for $607,545 plus costs.

The Authority and High Court correctly upheld that the Chief Executive was entitled to recover the gross amount because s 83A of the Social Security Act 1964 (given retrospective effect by the 2005 Amendment) governs source deduction payments; the appellant's challenges were a collateral re-litigation of issues already decided against him (including by the Court of Appeal in Goh), amounting to abuse of process, and the newly produced internal documents have no legal effect to displace the statutory regime and binding precedent.

The debtors failed to establish that the Commissioner owed them any sum under the alleged instruments and failed to prove an effective tender of the full debts; consequently the strike out application failed and the Commissioner was entitled to orders adjudicating the debtors bankrupt.
