The Court held the originating application was properly brought and granted the applicants leave under s280 to act as liquidators of FNZ, subject to service on creditors and leave for creditors to apply within ten working days to set aside the appointment; applicants' costs of the application are to be treated as liquidators' expenses limited to actual and reasonable costs.
