The Court of Appeal had no jurisdiction because the Associate Judge's decision was made in chambers under s26J of the Judicature Act 1908 and challenges to such decisions are by way of review in the High Court under s26P(1) and r2.3; therefore the appeal was dismissed for want of jurisdiction.

Leave to file the supplementary accountancy and expert evidence is granted notwithstanding lateness because the evidence is essential to the plaintiff's case, the court will address the prejudice to the defendant by offering adjournment and by making costs orders if an adjournment is sought, and the original setting down date remains operative so leave was required.

Leave to file the interlocutory application out of time and the application to vary the assets preservation order were declined because the defendant's delay was inexcusable and inadequately explained, the plaintiff would suffer substantial prejudice by altering the commercial dynamics on which she relied, and practical impediments (a caveat preventing mortgage registration and risk of security being voidable in bankruptcy) further undermined the justification for variation.
