Section 182(1) requires that a New Zealand court make an order under Part 4 of the Family Proceedings Act (or there be a final decree under the Matrimonial Proceedings Act 1963) before the Family Court may exercise s182 powers; recognition under s44 of an overseas dissolution does not constitute an order made under Part 4, therefore the Family Court lacked jurisdiction to hear Ms R's s182 application and the cross-appeal was allowed.
